1. Scope
1.1 These General Terms and Conditions (hereinafter "GTC") of Steffen Herchert, trading under "solarlager24" and "www.solarlager24.de" (hereinafter "Seller"), apply to all contracts for the delivery of goods concluded between a consumer or entrepreneur (hereinafter "Customer") and the Seller regarding the items presented by the Seller on the online portal "ebay," "eBay Classifieds," or at "www.solarlager24.de" using distance communication means (e.g., telephone, fax, email, letter) exclusively through individual communication within the meaning of Section 312j, Paragraph 5, Sentence 1 of the German Civil Code (BGB). The inclusion of the Customer's own terms and conditions is hereby objected to, unless otherwise agreed in writing.
1.2 These Terms and Conditions shall apply accordingly to contracts for the delivery of vouchers, unless expressly agreed otherwise.
1.3 A consumer within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor independent professional activity. An entrepreneur within the meaning of these Terms and Conditions is a natural or legal person, or a partnership with legal capacity, who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.
2. Conclusion of contract
2.1 The customer can submit a non-binding request to the seller via email or using the "Write message" function on the eBay Classifieds page. Upon request, the seller will send the customer a binding offer in text form (e.g., by email, fax, or letter) to sell the goods previously selected by the customer from the seller's product range.
2.2 The customer can accept this offer by submitting a declaration of acceptance to the seller by email or using the "Write message" function on the eBay classifieds page, or by paying the purchase price offered by the seller, in each case within 10 (ten) days of receipt of the offer. The day of receipt of the offer is not included in the calculation of the period. Acceptance by payment is deemed to be the day on which payment is received by the seller. If the last day of the period for accepting the offer falls on a Saturday, Sunday, or a public holiday recognized by the state at the customer's place of business, the next working day shall take the place of such a day. If the customer does not accept the seller's offer within the aforementioned period, the seller is no longer bound by its offer and may again freely dispose of the goods. The seller will specifically inform the customer of this in its offer.
3. Right of withdrawal
3.1 Consumers generally have a right of withdrawal.
3.2 Further information on the right of withdrawal can be found in the seller’s cancellation policy.
4. Prices and payment terms
4.1 Unless otherwise stated in the Seller's product description, the prices quoted are total prices, including statutory VAT. Any additional delivery and shipping costs will be stated separately in the Seller's offer.
4.2 Various payment options are available to the Customer, which will be communicated to him in the Seller’s offer.
4.3 If advance payment by bank transfer has been agreed, payment is due immediately after conclusion of the contract, unless the parties have agreed otherwise.
4.4 From 2023, VAT will be reduced to 0 percent for the following transactions: Supplies of solar modules to the operator of a photovoltaic system, including the components essential for the operation of a photovoltaic system and storage devices used to store the electricity generated by solar modules. The photovoltaic system is located on or near private homes, apartments, public buildings, and other buildings used for activities serving the public good. The requirements are deemed to be met if the installed gross capacity of the photovoltaic system is or will not exceed 30 kWp according to the market data register. In addition, as a private end customer with the aim of installing the system, I meet the following legal requirements according to Section 12 Paragraph 3 No. 1 of the UStG.
We would like to point out that VAT-free delivery of your order will only be possible if the legal framework permits it. If we require additional information or documents within the scope of legal requirements after your order has been placed and paid, we will notify you by email. If your order contains items that are not exempt from VAT under the new legislation (valid from January 1, 2023), we will also notify you by email. We reserve the right to request additional VAT payments if necessary.
5. Delivery and shipping conditions
5.1 The delivery of goods shall be made by dispatch to the delivery address specified by the customer, unless otherwise agreed.
5.2 If delivery of the goods fails for reasons for which the customer is responsible, the customer shall bear the reasonable costs incurred by the seller as a result. This does not apply to the shipping costs if the customer effectively exercises their right of withdrawal. If the customer effectively exercises their right of withdrawal, the provisions in the seller's cancellation policy apply to the return shipping costs.
5.3 In the case of self-collection, the Seller will first inform the Customer by email or telephone that the ordered goods are ready for collection. After receiving this email, the Customer can collect the goods from the Seller's warehouse after consultation with the Seller.
In this case, no shipping costs will be charged.
6. Retention of title
If the seller makes advance payments, he retains ownership of the delivered goods until the purchase price owed has been paid in full.
7. Liability for defects
7.1 If the purchased item is defective, the statutory liability for defects shall apply.
7.2 Deviating from this, the following applies to used goods: Claims for defects are excluded if the defect only becomes apparent after one year from delivery of the goods. Defects that occur within one year from delivery of the goods can be asserted within the statutory limitation period. However, the reduction of the liability period to one year does not apply.
for items that have been used for a building in accordance with their usual purpose and have caused its defectiveness or for claims for damages and reimbursement of expenses by the customer, as well as in the event that the seller has fraudulently concealed the defect.
7.3 The customer is requested to immediately report any goods delivered with obvious transport damage to the delivery company and to notify the seller of this. Failure by the customer to do so will have no effect on their statutory or contractual claims for defects.
8. Applicable law, contract language
8.1 All legal relationships between the parties shall be governed by the laws of the Federal Republic of Germany, excluding the laws governing the international sale of movable goods. For consumers, this choice of law shall apply only to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has his or her habitual residence.
8.2 The contract language is German.
9. Alternative dispute resolution
9.1 The EU Commission provides a platform for online dispute resolution on the Internet at the following link: https://ec.europa.eu/consumers/odr
This platform serves as a contact point for the out-of-court settlement of disputes arising from online sales or service contracts involving a consumer.
9.2 The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
